ニャ識 Terms of Service

These Terms set out the conditions for using ニャ識 (Nyashiki, the "App"). Users should review and understand these Terms before using the App.
1. Scope
These Terms apply to all matters relating to the use of the App between the user and the operator of the App (the "operator").
Where the operator presents individual conditions, explanations, or guidelines in the App, on the official website, in help pages, or through notices, those form part of these Terms. If an individual condition conflicts with these Terms, the individual condition prevails.
2. The Service
The App supports recording purchases and studying Japanese through receipt scanning, manual expense entry, household and budget management, extraction of Japanese words from receipts or photos, a word list, review cards, and learning history.
The App is designed to run entirely on the device, and the operator does not run a server for it. There is no account registration and no sign-in. Information the user enters into the App is stored on the user's device.
Analysis results, meanings, readings, parts of speech, examples, budget calculations, statistics, and other displayed content are reference information intended to assist the user's own review and study. They are not guaranteed to be accurate, complete, current, or fit for a particular purpose.
3. Fees
The App is provided free of charge. It contains no in-app purchases, subscriptions, or other paid features.
If a user uses the AI features described in Article 5, any fees for the AI provider the user contracts with arise between the user and that provider. The operator is not involved in and does not bear those costs.
4. Receipt Analysis, Recording, and Household Management
Before registering a receipt image or entered content in the App, users must confirm that they have lawful authority to use that information.
The App may analyze or infer store names, purchase dates and times, item names, amounts, payment methods, tax amounts, and candidate study words from receipt images or entered content. Analysis results may contain errors. Users must review the content before recording or saving it and correct it as needed.
For important payment verification, tax, accounting, refund, expense reimbursement, or similar decisions, users should also consult the original receipt, card statements, financial institution information, or an accounting professional.
5. AI Features
The App's core features work without AI. Receipts are read with on-device text recognition and parsing, and word meanings are shown from a dictionary bundled with the App.
AI features work only when the user registers their own AI provider API key in the settings screen. The App does not include an API key belonging to the operator.
When the user selects OpenAI or Google (Gemini), the relevant data is sent from the user's device directly to that provider. The transmission does not pass through any server of the operator, and the operator does not receive its contents. The handling of transmitted data is governed by the agreement and privacy policy between the user and that provider.
Users are responsible for managing their API key, reviewing the applicable terms, bearing the costs, and complying with the provider's terms. The operator is not responsible for provider specification changes, service suspension, response content, billing, or other matters attributable to the provider.
When Apple's on-device model is selected on a supported device, processing completes on the device.
6. Learning Features
The App may present words extracted or registered from receipts, photos, or manual entry as a word list, review cards, read-aloud audio, examples, and learning history.
Meanings, readings, parts of speech, read-aloud audio, examples, review intervals, and other learning information are intended to assist study and are not guaranteed to be linguistically or educationally complete.
7. User Content
Images, notes, receipt information, household information, learning information, and other information that a user registers, enters, or saves in the App is referred to as "user content".
User content is stored on the user's device. The operator does not collect, view, or use user content.
Users warrant that their user content does not infringe the copyright, trademark, portrait, privacy, trade secret, or other rights of any third party.
8. Prohibited Conduct
Users must not:
- act in violation of law or public order and morals;
- register information that infringes the rights of a third party;
- attempt to analyze, reverse engineer, modify, or circumvent the security of the App;
- use AI features to generate or process information that is illegal, harmful, discriminatory, rights-infringing, or that facilitates misuse;
- use the App to access a third-party AI provider improperly or in violation of that provider's terms; or
- engage in any other conduct the operator deems inappropriate.
9. Changes, Suspension, and Termination of the Service
The operator may change, suspend, or terminate all or part of the App for reasons including feature improvement, maintenance, incident response, legal compliance, security, or business considerations.
For significant changes or termination, the operator will give notice within a reasonable scope, before or after the fact, through in-app notices, the official website, or another appropriate method.
10. Data Storage, Deletion, and Backup
Users can review, correct, delete, and export stored data using the features in the App.
Deleting the App from the device removes the information stored in the App's reserved storage. Because the operator holds no copy of the data, deleted information cannot be restored.
Data may be lost through device failure, loss, user action, OS defects, and similar causes. Users should keep their own copies of important receipts, records, study materials, and accounting information, using the App's backup feature or another method.
Backup files are encrypted with a key derived from a passphrase the user sets. If the passphrase is lost, no one, including the operator, can decrypt the backup.
11. Intellectual Property
Copyright, trademark rights, design, characters, images, UI, programs, databases, text, logos, and other intellectual property relating to the App belong to the operator or the rightful owner.
Users may use the App for their personal or internal purposes in accordance with these Terms. Without the operator's permission, users may not reproduce, republish, modify, sell, lend, publicly transmit, or make secondary use of all or part of the App.
12. Disclaimer
Except to the extent required by law, the operator does not warrant that the App will always be available, or that analysis results, AI output, meanings, readings, budget calculations, learning results, or stored data will be complete, accurate, secure, or current.
Except in cases of the operator's intent or gross negligence, the operator is not liable for damage arising from user input errors, insufficient review, loss of originals, device failure or loss, AI provider outages or specification changes, the communication environment, the device environment, wrongful acts of third parties, or force majeure.
Where the Consumer Contract Act or other laws do not permit a disclaimer or limitation of liability, the disclaimers and limitations in these Terms apply only to the extent consistent with those laws.
13. Ending Use
Users may stop using the App at any time by deleting it from their device. Because there is no account, no withdrawal procedure is required.
If a user violates these Terms, the operator may take necessary measures to the extent permitted by law.
14. Changes to These Terms
The operator may amend these Terms within the scope permitted by law. Where an amendment conforms to the general interest of users, or is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances, the operator will publicize the amended Terms and their effective date through in-app notices, the official website, or another appropriate method.
If a user uses the App after an amendment takes effect, the user is deemed to have agreed to the amended Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. In the event of a dispute concerning the App or these Terms, the district court or summary court having jurisdiction over the operator's location shall be the exclusive court of first instance by agreement, to the extent permitted by law.
